Terms of Service

1. Acceptance of Terms & Modifications

By accessing our website, purchasing credits, or interacting with our AI travel planning services (the "Service"), you agree to be bound by these Terms of Service. You must be at least 18 years old to use VIBI Trip.

Privacy Policy: Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages. Please read it here at https://vibitravel.com/privacypolicy. Your agreement with us includes these Terms and our Privacy Policy.

We reserve the right to amend these Terms at any time. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

 

2. Description of Service & AI Disclaimer

VIBI Trip provides an Artificial Intelligence (AI) tool designed to generate customized travel guides and/or daily itineraries via a third-party AI interface. The final product is delivered to you as an HTML email sent to your registered email address. We act solely as an AI-assisted planning tool, not a travel agency. We do not book flights, hotels, or tours on your behalf.

  • AI Limitations ("Hallucinations"): AI systems can occasionally generate inaccurate, outdated, or fictitious information. VIBI does not guarantee the accuracy, completeness, or current validity of any AI-generated recommendations.

  • No Contractual Agreements by AI: The AI chatbot is not a natural person or an authorized agent of VIBI Trip. The AI cannot bind VIBI Trip to any contractual terms, promises, refunds, or obligations.

  • User Verification Required: The itineraries provided are suggestions only. You are strictly responsible for independently verifying all critical travel details prior to your trip (e.g., operating hours, visa requirements, safety conditions, and transit routes).

  • Assumption of Risk: All travel is undertaken at your own risk.

3. Account Access & Security

Your access to the VIBI AI interface is secured via a unique URL containing a security Token and your verified email address. Every session requires email verification through our active gateway. You are responsible for keeping your unique access link private. VIBI is not responsible for credits used by third parties if you have shared your access credentials.

4. Credits & The "6-Week Activity Window"

To ensure system performance, we operate a "rolling" activity window:

  • Active Sessions: Your active chat session in our gateway is stored for 6 weeks from your last interaction. After 6 weeks of inactivity, your active record will be cleared.

  • Account Reactivation: Your purchased credits are safe in our permanent Master Ledger. If your active session expires, you must use our "Check Credits" form with your registered email to restore your balance and receive a new access link.

  • Credit Expiration: Unless otherwise stated during purchase, purchased credits do not expire as long as VIBI Trip remains in operation.

5. Payments, Billing & Refund Policy

All payments are processed securely through our third-party payment processors. We do not collect or store your billing information.

  • Payment Warranties: If you wish to purchase any product or service made available through the Service ("Purchase"), you represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

  • Refund Policy: Except when required by law, paid purchases, credits, and Subscription fees are non-refundable.

6. User Content & On-The-Ground Service

Our on-the-ground Service allows users to paste names, links, and social media handles to aid in itinerary generation. You are solely responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

7. Prohibited Conduct

You agree to use VIBI Trip only for its intended lawful purpose. You strictly agree not to:

  • Attempt to bypass our security gateways, reverse-engineer Tokens, or manipulate our backend systems.

  • Use any robot, spider, scraper, or other automated means to access the Service or extract data.

  • Introduce viruses, trojan horses, or attack the Service via a denial-of-service (DDoS) attack.

  • Use the AI to generate illegal, harmful, discriminatory, or sexually explicit content.

  • Input highly sensitive personal data (such as passport numbers) into the AI chat interface.

VIBI reserves the right to terminate your access immediately and forfeit your remaining credits without refund if you violate these terms.

8. Communications

By creating an account or purchasing credits, you agree that we may send you transactional emails regarding your account status, credit balance, and session expirations. You may also receive promotional materials, which you can opt out of at any time via the "Unsubscribe" link.

9. Intellectual Property & Feedback

  • Your Itinerary License: You are granted a personal, non-exclusive license to use the generated HTML travel guides and/or daily itineraries for your personal travel planning.

  • Our Property: The Service and its original content (excluding Content provided by users), features, backend architecture, prompt engineering, and functionality are and will remain the exclusive property of Hi Ai Consulting and its licensors. The Service is protected by copyright, trademark, and other laws of the United States. Our trademarks, trade dress, and brand (VIBI Trip) may not be used in connection with any product or service without the prior written consent of Hi Ai Consulting.

  • Feedback: If you provide us with suggestions, ideas, or feedback regarding the Service, you agree that VIBI Trip may use, modify, and commercialize such feedback without any obligation, confidentiality, or compensation to you.

10. Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by VIBI Trip.

VIBI Trip has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

YOU ACKNOWLEDGE AND AGREE THAT VIBI TRIP SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS, OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH THIRD-PARTY WEB SITES OR SERVICES. WE STRONGLY ADVISE YOU TO READ THE TERMS OF SERVICE AND PRIVACY POLICIES OF ANY THIRD-PARTY WEB SITES OR SERVICES THAT YOU VISIT.

11. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIBI TRIP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIBI TRIP, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSS, PHYSICAL INJURY, TRIP CANCELLATIONS, OR DENIED BORDER ENTRIES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR AI-GENERATED ITINERARIES. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT YOU PAID TO VIBI TRIP FOR THE CREDITS IN DISPUTE.

13. General Provisions

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in California.

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

  • DMCA and Copyright: If you believe content on our platform infringes upon your copyright, please notify us as per our policy.
