Copyright & DMCA Policy

VIBI Trip respects the intellectual property rights of content creators and expects our users to do the same. As a service provider operating under the Digital Millennium Copyright Act ("DMCA"), we will respond promptly to notices of alleged copyright infringement that are properly reported to our Designated Copyright Agent.

1. Reporting Copyright Infringement (Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that material on our website, within our AI interface, or hosted in our generated itineraries infringes upon your copyrights, please submit a DMCA Notice of Alleged Infringement containing the following information:

  1. Identification of Original Work: A description of the copyrighted work claimed to have been infringed.

  2. Identification of Infringing Material: A description (ideally a specific URL or a copy of the generated PDF) of where on VIBI Trip's service we may find the potentially infringing material.

  3. Contact Information: Your name, address, telephone number, and email address.

  4. Good Faith Statement: A statement that you have a good faith belief that the use of the copyrighted work is not authorized by the copyright owner, its agent, or the law.

  5. Accuracy Statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

  6. Signature: An electronic or physical signature.

Note: We may share complete DMCA notices with affected users and third-party transparency databases, such as the Lumen Database.

2. Submitting Your Notice

For the fastest processing, we strongly recommend sending your notice via email.

3. DMCA Counter-Notifications

If you are a VIBI Trip user and believe that your content or generated itinerary was removed due to a mistake or misidentification, you may submit a Counter-Notice. Your Counter-Notice must include:

  1. Identification of Material: A description of the material that was removed and the location at which it appeared before removal.

  2. Contact Information: Your name, address, telephone number, and email address.

  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Jurisdiction Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, the United States District Court for the [Northern / Central / Southern] District of California, and that you will accept service of process from the person who filed the original DMCA notice.

  5. Signature: An electronic or physical signature.

The Counter-Notice Process: Pursuant to the DMCA, we will forward any complete counter-notification to the person who filed the original notice. That person may then choose to file a lawsuit against you. If we do not receive notice that such a lawsuit has been filed within 10 to 14 business days after we forward your counter-notification, we may restore the challenged materials. Until that time, your materials will remain removed.

4. Bans for Repeat Infringers

In accordance with the DMCA, VIBI Trip has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who repeatedly cause us to receive DMCA takedown notices. We will delete the user's account and use technical measures to restrict their access to our services.
